Welcome to Blush Med Spa ("we," "our," "us"). By booking an appointment, enrolling in a membership, purchasing products, or receiving treatments at our Boise, Idaho clinic, you ("Client," "you," "your") agree to be bound by these Terms and Conditions. Please read them carefully.

1. Medical Evaluations & Informed Consent

• Good Faith Exam: Advanced treatments (including injectables, laser resurfacing, IPL, and chemical peels) require a medical evaluation or "good faith exam" by our licensed medical director or mid-level practitioner prior to your first session. We reserve the right to refuse treatment if a procedure is deemed medically unsafe for you.

• Informed Consent: You must sign a clinical Informed Consent Form prior to receiving each unique treatment. These forms detail the specific clinical risks, side effects, and expected outcomes of your procedure.

• Accurate Health History: You agree to provide a complete and accurate health history, including all current medications (including topical skincare like Retin-A), allergies, medical conditions, and pregnancy or breastfeeding status. You must update our staff immediately if your health status changes between appointments.

2. Appointment Booking & Cancellation Policy

• Credit Card Required: A valid credit card must be kept on file to secure all appointment bookings.

• 24-Hour Cancellation Window: We require at least 24 hours' notice for any cancellation or rescheduling requests.

• Cancellation Fee: Late cancellations, late reschedules, or no-shows made less than 24 hours prior to the scheduled appointment time will automatically be charged a $50 fee to the credit card on file.

• Late Arrivals: If you arrive more than 10 minutes late, your appointment may be shortened or rescheduled to accommodate other clients, and the $50 late fee may apply.

3. Monthly Membership Program Terms

• One-Year Commitment: By enrolling in a Blush Med Spa monthly membership, you are legally committing to a minimum initial term of twelve (12) consecutive months.

• Automatic Billing: Membership dues are automatically billed monthly to your credit card on file on your designated billing date.

• 60-Day Cancellation Notice: To cancel your membership after or during your commitment term, you must provide a written 60 days' notice to our management team. You will be responsible for any membership dues that fall within that 60-day notification window.

• Non-Transferable: Membership benefits, discounts, and banked services are exclusive to the member and cannot be transferred to another individual.

4. Pricing, Payments, & Refunds

• Payment Due: Full payment is due at the conclusion of your treatment session.

• No Refunds on Services: All treatments—including injectables, laser resurfacing, IPL, laser hair removal, microneedling, chemical peels, facials, hydrafacials, and dermaplaning—are non-refundable once rendered. Cosmetic outcomes vary by individual; payment is for the clinical performance of the procedure, not a guaranteed aesthetic result.

• Product Returns: Medical-grade skincare products may only be returned for Blush Med Spa store credit within 14 days of purchase. The product must be completely unopened, unused, and in its original packaging. Opened products are final sale unless a severe clinical allergic reaction is documented by our staff.

• Package Expiration: All prepaid treatment packages must be utilized within 12 months from the date of purchase. Any unused sessions after 12 months will automatically expire and are non-refundable.

5. Photo Release & Clinical Records

• Clinical Documentation: We take confidential "before and after" photos of your treatment areas to legally document your clinical progress. These photos are securely stored in your medical file.

• Marketing Use: We will never use your photos for social media, marketing, or website displays without your explicit, separate written consent.

6. Clinic Safety & Conduct

• Age Restrictions: Clients under the age of 18 must be accompanied by a parent or legal guardian, who must provide written consent for any clinical treatment.

• Children and Guests: For strict safety reasons regarding our medical lasers and sharp instruments, children and unsupervised guests are not permitted in the treatment rooms during clinical procedures.

• Right to Refuse Service: We maintain a zero-tolerance policy for aggressive, disrespectful, or inappropriate behavior. We reserve the right to refuse service or terminate a client relationship at any time.

7. Limitation of Liability & Results Disclaimer

• No Guarantees: Human tissue responds uniquely to medical and aesthetic treatments. While we utilize industry-leading protocols, Blush Med Spa makes no absolute guarantees regarding the exact outcome of any treatment.

• Adherence to Aftercare: You agree to strictly follow all post-treatment instructions provided by our practitioners (including strict sun avoidance, SPF application, and skincare restrictions). Blush Med Spa is not liable for adverse outcomes, scarring, or hyperpigmentation resulting from a failure to follow prescribed medical aftercare.

• Governing Law: These terms are governed by and construed in accordance with the laws of the State of Idaho. Any legal actions arising from these terms must be filed in a court of competent jurisdiction in Ada County, Idaho.
